Terms of Service
Introduction
Geary is a vehicle and expense workspace application developed and operated by Eureka Soft Ltd (“Eureka Soft”, “we”, “us”). These Terms of Service (“Terms”) govern your access to and use of Geary’s websites (including geary.app), the web application at web.geary.app, mobile applications, and related services (collectively, the “Services”). By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Description of the Services
Geary helps individuals and teams manage vehicles, workspaces, expenses, documents, reminders, and related operational data in one place. Features may include personal and business workspaces, vehicle records, expense tracking, notifications, file and photo storage within your subscription limits, and other capabilities described in the product.
We may modify, add, or discontinue features to improve security, performance, compliance, or user experience. We strive to keep the Services reliable, but we do not guarantee uninterrupted, timely, or error-free operation.
Accounts and Security
You must provide accurate registration information and keep your login credentials confidential. You are responsible for all activity that occurs under your account.
You must notify us promptly if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms, pose a security risk, or must be restricted for legal reasons.
Acceptable Use
You agree to use the Services only for lawful purposes and in accordance with these Terms. Without limitation, you must not: (a) access or attempt to access data you are not authorized to view; (b) probe, scan, or test the vulnerability of our systems or breach security or authentication measures; (c) interfere with or disrupt the Services or servers or networks connected to the Services; (d) transmit malware, harmful code, or content that infringes third-party rights; (e) reverse engineer the client applications except where applicable law permits; (f) use shared workspaces or invitations in a way that violates applicable law or harms other users.
Subscriptions and Payments
Paid subscriptions, if offered, are processed through third-party platforms (such as the Apple App Store or Google Play) or as otherwise presented at the time of purchase. Prices, billing periods, auto-renewal, taxes, and cancellation are governed by the applicable platform’s terms and are shown at the point of purchase.
Free tiers may include usage limits (for example on vehicles, workspaces, or storage) as shown in the product. Upgrades and downgrades follow the rules of the platform or our in-app flows where applicable.
Intellectual Property
The Services—including software, branding, documentation, and materials we provide (excluding your content)—are owned by Eureka Soft or its licensors and protected by intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services in line with these Terms. You may not copy, modify, distribute, sell, or lease any part of the Services except as allowed by law or with our written consent.
You retain ownership of data you submit. You grant us a worldwide license to host, process, transmit, display, and back up such data solely to provide and improve the Services and as described in our Privacy Policy.
Disclaimers and Limitation of Liability
The Services are provided “as is” and “as available” to the fullest extent permitted by law. We disclaim all warranties not expressly stated, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by applicable law, neither Eureka Soft nor its suppliers shall be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill.
Our total aggregate liability for any claims arising out of or relating to the Services shall not exceed the greater of: (a) the amount you paid to us for the Services in the twelve (12) months before the claim, or (b) fifty euros (€50), except where mandatory law prohibits such a cap.
Changes to These Terms
We may update these Terms from time to time. We will post the revised Terms on this page and update the “Last updated” date. If changes are material, we may also notify you in the app or by email where appropriate. Continued use of the Services after the effective date constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by the laws of the Republic of Bulgaria, excluding conflict-of-law rules. Subject to mandatory consumer rights in your country of residence, courts in Bulgaria shall have jurisdiction over disputes arising from these Terms.
